*Trouble in APC as National Vice Chairman calls for resignation of Abdullahi Adamu, Omisore
Chuks Okocha and Adedayo Akinwale in Abuja
The candidate of the Peoples Democratic Party (PDP) in the February 25 presidential election, Atiku Abubakar has written to the Chairman of Independent National Electoral Commission (INEC) Prof. Mahmood Yakubu, demanding immediate compliance with a recent court order on the inspection of the election materials used during the poll.
On the same day, the All Progressives Congress (APC) National Vice Chairman (North-west), Dr. Salihu Lukman called for the resignation of the party’s National Chairman, Abdulahi Adamu and National Secretary, Senator Iyiola Omsiore, in the interest of the party. Also yesterday, the PDP asked the Police, the Department of State Security (DSS) and the Economic and Financial Crimes Commission (EFCC) to commence prosecution of the INEC chairman and some officials of the commission “for financially compromising the electoral laws through inducement.”
Atiku and Peter Obi of the Labour Party (LP), who lost the presidential election to Bola Tinubu of the APC, refused to concede defeat and approached the Court of Appeal, requesting to inspect the election materials used. The request was granted on March 3.Yesterday, Atiku’s lead counsel, Joe Gadzama wrote on behalf of his client to the INEC Chairman, calling for immediate compliance with the court’s order on access, inspection, examination and analysis of the presidential election materials.Gadzama wrote: “You will recall that the Court of Appeal, presided over by Hon. Justice Shagbaor Ikyegh, JCA sitting in Abuja, granted orders on March 3 2023 in favour of our clients.
“The Court expressly ordered INEC to allow and grant access to our clients and their representatives to inspect, scan, make copies, forensically audit and obtain certified true copies (CTC) of all electoral materials which were used in the conduct of the presidential election.“The Court in Order no. 6 specifically allowed our clients to carry out forensic examination/analysis of the BVAS machines/devices and all information stored in the server/IREV/backend/clouds, amongst others. The enrolled court order was duly and promptly served on the Commission on the same 3 March 2023 by the Court bailiff accompanied by our clients’ representatives.
“We have attached the acknowledged copy of the court order for ease of reference. It is our clients’ brief that upon service of the order, they immediately requested a date to follow up and they were asked to return on 6 March 2023.“On 6 March, our clients’ representatives, led by Adedamola Fanokun, Esq (office of the PDP National Legal Adviser), returned to the Commission ready to commence inspection, examination and obtaining of the electoral materials as ordered by the Court but they were informed at the Commission’s legal registry that there was no instruction yet from the Commission on the Court Order.“Our Clients further requested an audience with the Commission’s Director of Litigation to accelerate the process but they were not allowed as they were told by the Registry staff that the Director was in a meeting.
“Sadly, these and other efforts by our clients have yielded no result. It is disturbing that despite service of the Court Order on the Commission since 3 March 2023, the Commission is yet to allow our clients and their representatives to access, inspect and/or obtain the needed electoral materials as ordered by the Court despite repeated visits to the Commission and follow-up in respect thereof. No doubt, the Commission is bound by the orders of the Court and cannot choose if, when and/or how to comply with the same.“The unqualified obligation of the Commission, which of course includes INEC officials, is to unhesitatingly comply and give effect to the subsisting order of Court; there is no discretion to exercise here. In the circumstances, we hereby demand that the Commission should immediately comply with the subsisting orders of Court and in particular, we reiterate the following demands on behalf of our Clients:
“Daily access to all polling documents, voters register, ballot papers and electoral forms/materials for purposes of scanning, forensic audit, expert examination and inspection; Daily access to the BVAS machines/devices and server/IREV/backend/clouds for purposes of forensic examination and analysis; and CTCs of all BVAS accreditation reports, forms EC40A, EC8A, EC8AVP, EC8C, EC8D, EC8E and all other electoral forms/materials on a State by State basis.
“We hope that our demand will receive the prompt positive action that it requires as we will continue to visit the Commission on a daily basis for the exercise as set out above in line with the subsisting order of the Court. Thank you in anticipation of your urgent positive action in this regard as time is really of the essence.”The Justice Joseph Ikyegh-led panel of the appellate court, which will also sit as the Presidential Election Petition Tribunal, granted the request for inspection of the electoral materials on March 3 after it heard two separate ex-parte applications brought by Atiku, Obi and their political parties.Tinubu, who won the February 25 election scored 8,794,726 votes, the highest of all the candidates, thus meeting the first constitutional requirement to be declared the winner.
He also scored over 25 per cent of the votes cast in 30 states, more than the 24 states constitutionally required. The INEC Chairman, who announced the final results, said Atiku came second with 6,984,520 votes. Obi came third with 6,101,533 votes while Rabiu Kwankwaso of the NNPP came fourth with 1,496,687 votes.Atiku and Obi have refused to concede defeat, vowing to recover their mandates in court.Vice Chairman demands Resignation of Adamu, OmisoreThe APC National Vice Chairman, Lukman is calling for the resignation of Adamu and Omsiore for a number of reasons.Lukman in a statement issued yesterday titled, “APC Internal Dynamics and the Future of Democracy”, said it was important that even before May 29, 2023 when Tinubu would be sworn in as President, every step must be taken to rectify any situation that might be used to continue divisive campaigns and propaganda against the APC and its control of the federal government.
To this end, he called for an Emergency National Convention where the new national leadership of the party would emerge. He said with a National Chairman who is also a Muslim, it would be important that every necessary step was taken to inject a change of leadership for the party so that a new National Chairman who is a Christian takes over.
To him, part of the advantage of this was that the National Chairman could be retained in North-Central.The party chieftain stressed that the current National Chairman has done an excellent job to manage a successful campaign to win the 2023 election with all the attendant challenges, adding that there should be no difficulty in convincing Adamu to resign to create opportunity for a Christian Chairman to emerge.According to him, “For that to happen, it may require an Emergency National Convention because if the hierarchy of the current leadership is to be followed, the successor to Sen. Adamu will be Sen. Abubakar Kyari who is a Muslim from the North-east.”
Lukman stressed that apart from changing the National Chairman, there was the need to address the case of the National Secretary of the party. He stated categorically that Omisore had become a source of strong dispute in Osun State. He noted: “Unfortunately, rather than serving as a unifying factor for the party leadership in Osun State, Omisore is more a divisive factor, which may have been responsible for why APC lost the 2022 Governorship election to a political mediocre whose only qualification in politics may appear to be comic dancing skill.”Lukman also said there was need for APC leadership to properly plan the distribution of key positions in the federal government to reflect both ethnic, religious, gender and other demographic considerations.Against this background, he called on the leadership of the party to zone the positions of the Senate President and the Speaker House of the Representatives to North-west, South-east or South-south.
Lukman pointed out that given that the President and Vice President are from South-west and North-east respectively, nobody from either of these two regions should aspire for the positions of Senate President or Speaker of the House of Representatives. He said opportunists might argue that in the last four years, the South-west also produced the Vice President and Speaker of the House of Representatives, but insisted that the party must correct this kind of lop-sided reality as a strategic approach to dousing ethnic and religious tension in the country.
Lukman stated: “Accordingly, the positions of Senate President and Speaker House of Representatives should be zoned to North-west, South-east or South-south. With a Muslim President and a Muslim Vice President, it is only logical to zone the Senate President who is the number three ranking leader of government to either the South-east or South-south who would be a Christian.“Logically, the position of Speaker of the House of Representatives should be zoned to the North-west. This would have the advantage of acknowledging that the North-west gave Asiwaju Tinubu the highest votes of 2,950,393, representing 33.6% of the votes he won.”
PDP wants INEC Chairman ProsecutedFor the second time in 10 days, the PDP has called on Yakubu to resign as INEC Chairman.PDP also asked the Police, the Department of State Security (DSS) and the Economic and Financial Crimes Commission (EFCC) to commence criminal prosecution of the INEC Chairman and some officials of the commission for “financially compromising the electoral laws through inducement.”
The National Publicity Secretary of the PDP, Debo Ologunagba who made the demands at a press conference in Abuja yesterday said: “The party has further reviewed the widely-condemned infractions, brazen violation of the provisions of the Electoral Act, 2022 and criminal manipulation and alteration of election results by the Yakubu-led INEC to subvert the Will of Nigerians in the February 25, 2023 Presidential and National Assembly Elections.
“The PDP has also reviewed the latest scheme by INEC to reconfigure the BVAS devices, erase and destroy evidence of its manipulation of the Presidential election, deny Nigerians and political parties, especially our party and candidate access to relevant information required to prosecute our case at the Presidential Election Tribunal.
“It is also obvious that the Commission under Prof. Yakubu deliberately sabotaged the uploading and transmission of results directly from the Polling Units to give room for the criminal mutilation, alteration and switching of election results across the nation in favour of the APC as now abundantly exposed in the pictorial and video evidence of compromised results sheets in many parts of the country.”
Consequently, Ologunagba said the PDP demands that Yakubu should immediately step down from office, having allegedly abused the confidence and dashed the hope of millions of Nigerians, as well as political parties and the international community for a free, fair and credible election.Furthermore, he said “the PDP demands that the Inspector General of Police and the Director General of DSS immediately commence investigations into the electoral violations and manipulations by INEC with the view to prosecuting Prof. Yakubu and other officials of the Commission for electoral offences.“In the same vein the EFCC should open investigation into allegations that certain top officials of INEC were heavily compromised financially to manipulate the electoral process.”

- 6′ Breaking NewsLabour Party Threatens to Occupy INEC Offices Nationwide over Commission’s Refusal to Allow Inspection of MaterialsBreaking | 4 mins ago*Accuses INEC of reconfiguring BVAS without the representatives of parties *Obi’s lawyers vow to take legal action against electoral umpireSegun JamesThe Labour Party (LP) has accused the Independent National Electoral Commission (INEC) of frustrating its petition against the outcome of the 2023 presidential election by not allowing it to inspect election materials as ordered by the Appeal Court.LP also raised the alarm that INEC had started reconfiguring the Bimodal Voter Accreditation System (BVAS) without the presence of the representatives of political parties. This is as the legal team of the presidential candidate of the LP, Mr. Peter Obi has vowed to take legal action against the commission over its “deliberate” refusal to allow its client to inspect presidential election materials in line with the orders of the Court of Appeal. At a press conference in Lagos yesterday, the party’s spokesman, Dr. Yunusa Tanko, accused INEC of disobeying the order of the Presidential Election Petition Tribunal, which directed it to grant the party and its presidential candidate, Obi, access to true certified copies of materials used in the conduct of the presidential poll.Tanko said the order of the presidential election petition tribunal was duly served on INEC on March 3, even though the commission was also present and represented at the tribunal when the order was made.He added that the party also sent a letter to the commission on March 6, reminding the electoral umpire that it was yet to obey the order.Tanko threatened that LP might ask its supporters to stage protests nationwide at the offices of the commission over its refusal to obey the court order.“It should be noted that in a democracy like ours, the rule of law must triumph not only in our legal system but also in our body polity. Parties to litigation, like in the instant case, must accept and obey every order of the court in good faith, and no party should be seen to employ self-help to disparage or disrespect an order of the court, which, if not checked and curtailed, could undermine our democracy, the rule of law and constitutionalism.“The action of INEC under reference also constitutes, for all intent and purposes, an act of judicial insubordination and willful refusal to comply with the order of the court,” he said.He noted that while INEC has refused the party access to the election materials, the commission had also started reconfiguring the BVAS machines without the parties’ representatives in the case in attendance to confirm the data being backed up.“We, therefore, call on the general public to note the level of lawlessness and brazen disobedience to a lawful order of a court by an important statutory agency such as INEC, which is a well-calculated attempt to undermine and frustrate the presentation of the petition by the Labour Party and its presidential candidate, Obi before the tribunal in good time.“We, therefore, want to state that we will not fail to call our supporters to march to INEC offices nationwide in a non-violent protest, which is allowed by law. This is to curtail the flagrant disobedience to court orders by INEC,” he added.Tanko, who maintained that Obi won the presidential election from the results submitted by its party agents from the polling units, urged Nigerians to vote for the candidates of the party in the rescheduled March 18 governorship and state assembly elections.Meanwhile, Obi’s legal team has vowed to take legal action against the INEC for the commission’s “deliberate” refusal to allow its client to inspect the presidential election materials in line with the orders of the Court of Appeal. The Court of Appeal had issued an order allowing Obi, the LP, and the Peoples Democratic Party (PDP) to inspect materials used for the February 25 presidential election, which INEC declared was won by Bola Tinubu of the All Progressives Congress (APC).INEC, on March 6, filed a motion on notice, praying the court to vary the orders to enable the commission to reconfigure accreditation machines used for the election to enable their use for the forthcoming governorship and state assembly elections. The appellate court, at its discretion, allowed INEC to reconfigure the BVAS but insisted that its earlier order granting Obi access to election materials still exists.INEC, in reaction to the ruling, stated, “We wish to reiterate that the commission is not against litigants inspecting election materials. Consequently, it will continue to grant all litigants access to the materials they require to pursue their cases in court.”But a member of Obi’s legal team, Alex Ejesieme (SAN), told THE WHISTLER that the electoral umpire had not granted them access to election materials.“Well, we have written to them (INEC); we have done everything possible, and they have refused to allow us to inspect. So, we will review our positions this weekend, and by Monday, we will know the next thing to do,” the lawyer said.He accused INEC of deliberately trying to delay Obi’s legal team from instituting a petition against the presidential election as prescribed by the Electoral Act, adding that the electoral umpire knows that accessing the election materials will expose alleged ballot rigging in the election.“Yes. You know, what they are doing is deliberate. Ordinarily, the proper thing for us to do is to commence committal proceedings against the INEC chairman and the officers involved but remember, by the Electoral Act 2022, we are supposed to file a petition.“So, what they are trying to do is to divert attention,” Ejesieme said, adding, “we will take steps to mount pressure on them to allow us to have copies of the electoral materials in line with the order of the court of Appeal.”While the collation of presidential results was ongoing on February 26, the LP, PDP, and the Action Democratic Congress (ADC) agents had boycotted the exercise and called for the cancellation of the election.International observers from the European Union also accused INEC of a “lack of transparency” due to its failure to immediately transmit results electronically from polling units to its public result viewing portal.Regarding access to election documents, Section 74 of the Electoral Act 2022, reads as follows, “74 (1) The Resident Electoral Commissioner in a state where an election is conducted shall, within 14 days after an application is made to him by any of the parties to an election petition, cause a true certified copy (CTC) of such document to be issued to the said party.“(2) Any Resident Electoral Commissioner who willfully fails to comply with the provisions in subsection (1) commits an offence and is liable on conviction to a maximum fine of N2,000,000 or imprisonment for a term of 12 months or both.”However, with the revelation by Tanko that the order of the presidential election petition tribunal was served on INEC on March 3, while the party also sent a letter to the commission on March 6, the 14 days deadline allowed by the law for INEC to produce the CTC of the election documents has not expired. This would have the advantage of acknowledging that the North-west gave Asiwaju Tinubu the highest votes of 2,950,393, representing 33.6% of the votes he won.”PDP wants INEC Chairman ProsecutedFor the second time in 10 days, the PDP has called on Yakubu to resign as INEC Chairman.PDP also asked the Police, the Department of State Security (DSS) and the Economic and Financial Crimes Commission (EFCC) to commence criminal prosecution of the INEC Chairman and some officials of the commission for “financially compromising the electoral laws through inducement.”The National Publicity Secretary of the PDP, Debo Ologunagba who made the demands at a press conference in Abuja yesterday said: “The party has further reviewed the widely-condemned infractions, brazen violation of the provisions of the Electoral Act, 2022 and criminal manipulation and alteration of election results by the Yakubu-led INEC to subvert the Will of Nigerians in the February 25, 2023 Presidential and National Assembly Elections.“The PDP has also reviewed the latest scheme by INEC to reconfigure the BVAS devices, erase and destroy evidence of its manipulation of the Presidential election, deny Nigerians and political parties, especially our party and candidate access to relevant information required to prosecute our case at the Presidential Election Tribunal.“It is also obvious that the Commission under Prof. Yakubu deliberately sabotaged the uploading and transmission of results directly from the Polling Units to give room for the criminal mutilation, alteration and switching of election results across the nation in favour of the APC as now abundantly exposed in the pictorial and video evidence of compromised results sheets in many parts of the country.”Consequently, Ologunagba said the PDP demands that Yakubu should immediately step down from office, having allegedly abused the confidence and dashed the hope of millions of Nigerians, as well as political parties and the international community for a free, fair and credible election.Furthermore, he said “the PDP demands that the Inspector General of Police and the Director General of DSS immediately commence investigations into the electoral violations and manipulations by INEC with the view to prosecuting Prof. Yakubu and other officials of the Commission for electoral offences.“In the same vein the EFCC should open investigation into allegations that certain top officials of INEC were heavily compromised financially to manipulate the electoral process.” CommentsRelated articlesAlleged Racism: Seplat’s CEO Steps Aside, Hands over to COO Levelling the Playing Field for Women 5 Women Championing Female Inclusion in Entertainment Industry UN: Killing of 30 Borno Fishermen by ISWAP Deeply Shocking Three Exciting Guber Races of March 18th Boris Johnson to Deliver 2023 Anyiam-Osigwe Lecture What the Taxi Driver Told MePowered bymarfeel logoLogoFounded on January 22, 1995, THISDAY is published by THISDAY NEWSPAPERS LTD., 35 Creek Road Apapa, Lagos, Nigeria with offices in 36 states of Nigeria , the Federal Capital Territory and around the world. In contrast, the party with the second highest number of lawmakers in the chamber would produce the minority principal officers. The principal officers, who are the leaders of the majority and minority caucuses, are constituted based on the membership configuration in the lower chamber. While the majority caucus is expected to produce the majority leader, the deputy majority leader, the chief whip, and the deputy whip, the minority caucus will produce the minority leader, the deputy minority leader, the minority whip, and the deputy minority whip.Ranking members, who are returning for the second or more time, are automatically qualified to contest the principal office positions either from the majority or the minority caucus.Out of the 360 seats in the House of Representatives, the All Progressives Congress (APC) won 162 seats; while the Peoples Democratic Party (PDP) won 102.The Labour Party (LP) and the New Nigeria People’s Party (NNPP) won 34 and 18 seats, respectively, while the All Progressives Grand Alliance (APGA) got four seats. On their part, the Social Democratic Party (SDP) and African Democratic Congress (ADC) won two seats each, while the Young Progressive Party (YPP) clinched one seat.Following the issuance of certificates of return to the members–elect last Wednesday, the race for the two major presiding offices – Speaker and Deputy Speaker has begun among ranking lawmakers who are members of the APC.With the current Speaker, Hon. Femi Gbajabiamila, and the President-elect, Senator Bola Tinubu coming from Lagos State, the current speaker will likely not retain his position in the 10th National Assembly.THISDAY learnt from a close associate of Gbajabiamila that he would prefer to play any other prominent role in Tinubu’s administration to return to the House as an ordinary member.Gbajabiamila was conspicuously absent at the International Conference Centre (ICC) Abuja venue of the presentation of Certificates of Return, fuelling speculations that he might take a more prominent position in the incoming administration.Though the APC has not zoned the officers, further investigations by THISDAY revealed that the South-east and North-west geopolitical zones are strongly being considered for the speaker position. However, only six of the 43 members-elect from the South-east geopolitical zone are serving in the current Assembly, including the current House spokesman, Hon. Benjamin Kalu (APC, Bende Federal Constituency in Abia), and the Chairman of the House Committee on Aviation, Hon. Nnolim Nnaji (PDP, Nkanu-East/West).However, those who make a case for the North-west on the speaker’s position argued that the Senate President should go to the South-east. They maintained that the speaker’s position is enough to compensate the North-west for producing the highest number of votes for the APC in the presidential and National Assembly elections, given that the outgoing President, Muhammadu Buhari, hails from the zone. However, other members-elect from other zones, such as the North-central and North-east, are said to be interested in the position.Among the South-east lawmakers, Kalu (APC, Abia) is believed to be seriously mobilising his colleagues to emerge as the speaker, while Hon. Idris Wase (APC, Plateau) is also eyeing the top job from the North-central geopolitical zone.Similarly, Hon. Muktar Aliyu Betara (APC, Borno) is contesting the position from the North-east geopolitical zone. From the North-west geopolitical zone, the duo of Hon. Aminu Jaji (APC, Zamfara) and Alhassan Ado Doguwa (APC, Kano) are both eyeing the seat.Tinubu, Shettima, APC Leaders to Meet N’Assembly Members-elect Tomorrow over Zoning of Principal Offices Meanwhile, the meeting between Tinubu, Shettima, the leadership of the ruling APC, and the National Assembly members-elect scheduled for Monday at the Banquet Hall of the State House, Abuja, will discuss the issue of zoning and the March 18 elections.A ranking APC Senator who was also re-elected during February 25, 2023, National Assembly poll told THISDAY that the meeting was called to preview the March 18 elections and discuss the zoning of the leadership of the 10th National Assembly billed for inauguration in June. The South-south Senator, who spoke on condition of anonymity, said the APC leadership believed it was high time the federal parliamentary election was reviewed to plan ahead of the next Saturday’s electionsAccording to him: “Monday’s meeting will not only review last month’s poll that produced majority APC Senators-elect for 10th National Assembly but will also ensure that all hands are on deck to ensure that coming Saturday’s elections are crisis-free with the ruling party consolidating and improving on its stronghold across the country”.He added that the second item on the agenda of the meeting scheduled to start by 2 pm with APC National Chairman, Senator Abdullahi Adamu presiding, is the issue of the leadership of the 10th National Assembly, which is supposed to be handled by the party leadership as it presently has 57 Senate seats out of the 98 Senate seats declared so far.APC leaders, he further said, would use the forum to brief the elected parliamentarians on their line of thought over where the presiding officers of the two chambers of the 10th National Assembly will come from.Sources at the weekend also told THISDAY that both the South-east and South-south are favoured to produce the Senate President of the 10th Assembly as the race hots up.On Friday, APC National Vice Chairman, North-west, Dr. Salihu Lukman, had called on the party’s leadership to zone the positions of the Senate President and the Speaker House of the Representatives to North-west, South-east or South-south.THISDAY’s investigation revealed that the odds favoured the South-east and South-south to occupy the number three seat in the land.A source who preferred to remain anonymous told THISDAY that while the former Governor of Abia State, Senator Orji Kalu, is eyeing the covered seat, former Governor of Akwa Ibom State, Senator Godswill Akpabio, Senator Osita Isunaso and the Governor of Ebonyi State, Dave Umahi are also interested the position. The source said: “The South-east is favoured under the circumstances, and I know Orji Kalu is positioning for it, and he’s lobbying Asiwaju very well.“Umahi wants it too, but I think what will count against him is that he’s a first-timer. But some people say that it doesn’t really matter, that it is not in their rule that a first timer cannot do it. After all, Godswill Akpabio was a first-timer when he became a principal officer.“I also know Akpabio too is pushing for it, but I don’t know how that will pan out. Akpabio argues that the position is not sacrosanct to the South-east, it is whoever can get the support.”Other ranking APC Senators being tipped for the 10th Senate Presidency include former Senate Leader, Senator Ali Ndume; former Governor of Gombe State, Senator Danjuma Goje; Chairman of Senate Services Committee, Senator Sani Mohammed Musa and Chairman of Senate Committee on Appropriations, Senator Jubrin Barau.Sources claimed all the interested Senators are already reaching out to their colleagues, especially the new Senators-elect.One of the contenders for the coveted seat of the Senate President, Senator Barau, has already met formally with 70 senators-elect in Abuja. The aim of the hosting at Transcorp Hilton during the week was for the Senators-elect to form the needed bond ahead of the inauguration of the federal parliament in June.THISDAY learnt that Senator Barau organised the event to enable him to interact with his colleagues. However, a member of the National Working Committee (NWC) of the APC told THISDAY that the party may settle for a Christian Senator-elect as President of the Senate “to douse the tension generated by the same faith presidential ticket of our great party, the APC.” No fewer than 98 out of 109 senators were given certificates of return last Tuesday by the INEC at the International Conference Centre, Abuja.A total of seven political parties won senatorial seats, with APC topping the list with 50 seats. The Peoples Democratic Party (PDP) won 29 seats; Labour Party won six; New Nigerian People’s Party (NNPP) two; Social Democratic Party (SDP) also two; the All Progressives Grand Alliance (APGA) and Young Peoples Party (YPP) won one seat each. Accuses INEC of reconfiguring BVAS without the representatives of parties
*Obi’s lawyers vow to take legal action against electoral umpire
Segun James
The Labour Party (LP) has accused the Independent National Electoral Commission (INEC) of frustrating its petition against the outcome of the 2023 presidential election by not allowing it to inspect election materials as ordered by the Appeal Court.LP also raised the alarm that INEC had started reconfiguring the Bimodal Voter Accreditation System (BVAS) without the presence of the representatives of political parties.
Yunusa Tanko, accused INEC of disobeying the order of the Presidential Election Petition Tribunal, which directed it to grant the party and its presidential candidate, Obi, access to true certified copies of materials used in the conduct of the presidential poll.
Tanko said the order of the presidential election petition tribunal was duly served on INEC on March 3, even though the commission was also present and represented at the tribunal when the order was made.
He added that the party also sent a letter to the commission on March 6, reminding the electoral umpire that it was yet to obey the order.Tanko threatened that LP might ask its supporters to stage protests nationwide at the offices of the commission over its refusal to obey the court order.“It should be noted that in a democracy like ours, the rule of law must triumph not only in our legal system but also in our body polity. Parties to litigation, like in the instant case, must accept and obey every order of the court in good faith, and no party should be seen to employ self-help to disparage or disrespect an order of the court, which, if not checked and curtailed, could undermine our democracy, the rule of law and constitutionalism.
“The action of INEC under reference also constitutes, for all intent and purposes, an act of judicial insubordination and willful refusal to comply with the order of the court,” he said.He noted that while INEC has refused the party access to the election materials, the commission had also started reconfiguring the BVAS machines without the parties’ representatives in the case in attendance to confirm the data being backed up.
“We, therefore, call on the general public to note the level of lawlessness and brazen disobedience to a lawful order of a court by an important statutory agency such as INEC, which is a well-calculated attempt to undermine and frustrate the presentation of the petition by the Labour Party and its presidential candidate, Obi before the tribunal in good time.
“We, therefore, want to state that we will not fail to call our supporters to march to INEC offices nationwide in a non-violent protest, which is allowed by law. This is to curtail the flagrant disobedience to court orders by INEC,” he added.
Tanko, who maintained that Obi won the presidential election from the results submitted by its party agents from the polling units, urged Nigerians to vote for the candidates of the party in the rescheduled March 18 governorship and state assembly elections.Meanwhile, Obi’s legal team has vowed to take legal action against the INEC for the commission’s “deliberate” refusal to allow its client to inspect the presidential election materials in line with the orders of the Court of Appeal.
Consequently, it will continue to grant all litigants access to the materials they require to pursue their cases in court.”
But a member of Obi’s legal team, Alex Ejesieme (SAN), told THE WHISTLER that the electoral umpire had not granted them access to election materials.“Well, we have written to them (INEC); we have done everything possible, and they have refused to allow us to inspect. So, we will review our positions this weekend, and by Monday, we will know the next thing to do,” the lawyer said.
He accused INEC of deliberately trying to delay Obi’s legal team from instituting a petition against the presidential election as prescribed by the Electoral Act, adding that the electoral umpire knows that accessing the election materials will expose alleged ballot rigging in the election.“Yes. You know, what they are doing is deliberate. Ordinarily, the proper thing for us to do is to commence committal proceedings against the INEC chairman and the officers involved but remember, by the Electoral Act 2022, we are supposed to file a petition.
“So, what they are trying to do is to divert attention,” Ejesieme said, adding, “we will take steps to mount pressure on them to allow us to have copies of the electoral materials in line with the order of the court of Appeal.”While the collation of presidential results was ongoing on February 26, the LP, PDP, and the Action Democratic Congress (ADC) agents had boycotted the exercise and called for the cancellation of the election.
International observers from the European Union also accused INEC of a “lack of transparency” due to its failure to immediately transmit results electronically from polling units to its public result viewing portal.Regarding access to election documents, Section 74 of the Electoral Act 2022, reads as follows, “74 (1) The Resident Electoral Commissioner in a state where an election is conducted shall, within 14 days after an application is made to him by any of the parties to an election petition, cause a true certified copy (CTC) of such document to be issued to the said party.
“(2) Any Resident Electoral Commissioner who willfully fails to comply with the provisions in subsection (1) commits an offence and is liable on conviction to a maximum fine of N2,000,000 or imprisonment for a term of 12 months or both.”
However, with the revelation by Tanko that the order of the presidential election petition tribunal was served on INEC on March 3, while the party also sent a letter to the commission on March 6, the 14 days deadline allowed by the law for INEC to produce the CTC of the election documents has not expired.

*PDP wants EFCC, Police, DSS to commence prosecution of INEC’s Chairman/officials for ‘financially compromising electoral laws’

Alleged Racism: Seplat’s CEO Steps Aside, Hands over to COO
Breaking | 5 hours ago
Peter Uzoho
Seplat Energy PLC yesterday announced that its Chief Executive Officer, Roger Brown, a Briton, has stepped down from office following the order of a Federal High Court in Lagos last Wednesday. The court had restrained Brown, from parading himself as the firm’s CEO, pending the determination of a suit filed against him and others by aggrieved stakeholders of the company.
The aggrieved stakeholders accused Brown of racism, favouritism for expatriate workers, discrimination against Nigerians, and breach of good governance. The statement announcing Brown’s resignation was signed by the Chairman of the board of Seplat, Basil Omiyi, who stated further that the embattled CEO had delegated authority to Seplat’s Chief Operating Officer, Samson Ezugwore, to act as CEO during this period.
The statement revealed that Seplat had been served the court processes and the ex parte order of Justice Chukwuejekwu Aneke of Federal High Court, Lagos, “restraining Brown from participating in the running of the Company for a period of 7 days.”According to Seplat, the court order was premised on allegations of unfair, prejudicial, and offensive acts by the Chairman, CEO and all of the Independent Non-Executive Directors of Seplat Energy.
The allegations include that the CEO organised a site visit for a number of its major shareholders to the company’s operations, cancelled some catering and landscaping contracts, and introduced a new job performance rating.Refuting the claims, Seplat Energy said that Nigerians had been appointed to the company’s most important positions, including Chairman, Senior Independent Non-Executive Director, Chief Financial Officer and Chief Operating Officer, since Roger became CEO in 2020.The board stated that the allegations levelled against it were reactions to its enforcement of corporate governance standards and a determination to continue to uphold its fiduciary duties to the company.
The statement reads, “The Order allows the Chairman, Mr Basil Omiyi, and all the INEDS of Seplat Energy to continue running the affairs of the Company on the basis that it is in accordance with Nigerian law.“Mr. Brown has delegated authority to Mr. Samson Ezugwore, Chief Operating Officer, to act as CEO during the period that he is required to step back from his executive duties.
“Seplat will follow the due processes of law in responding to the allegations before the courts. At the same time, the Company will continue to maintain its operational excellence and act in line with the best corporate governance standards.”The case was adjourned to March 23, 2023, for a hearing on the pending application.Recall that the Ministry of Interior has revoked Brown’s work permit, visa, and residence permit over allegations of racism and discrimination. The Ministry, in a letter dated March 3, 2023, and addressed to the chairman of Seplat’s board, conveyed its decision revoking Brown’s work permit, visa, and residence permit.
Seplat has denied the allegations levelled against Brown. In a statement signed by Omiyi, the board of Seplat denied the allegations.Part of the statement read, “The Board believes that these allegations are a spurious and vindictive reaction to the enforcement of corporate governance standards in the Company by the Board of Seplat Energy. Over the past decade, Mr. Brown has earned an unblemished record of service and leadership in the Company.
“In March 2023, the Board of Seplat Energy unanimously passed a vote of confidence in Mr. Brown, who continues to discharge his duties and responsibilities as CEO from the SEPLAT UK office.”It was also revealed that the company will be engaging with the Interior ministry on the matter which they claimed wasn’t brought to the attention of the CEO.Brown joined Seplat in 2013, as the Chief Financial Officer and was made the company’s CEO in November 2019. He effectively assumed office in 2020.

Emmanuel Samuel Inyang

My Dad Boy Alone passed away when I was just 12. I had to take care of my family so I left home at 13 and joined the Illeg@l refinery in Naija Delta, During this time, I lost many friends.
At 16, I started working as a laundry man.’ My dream was to learn how to produce my music by myself, so I served under my mentor, a gospel music producer, for a year and a half. Initially, I wanted to be a rapper but my teacher, Dr. Roy, explained that he could only teach me gospel music production. Hence, I had to quit my rap ambitions.
Dr. Roy never taught me how to produce; instead, I served as an errand boy in the studio. When the day ended, he’d pay for my transport home. I would pretend to leave but return to the studio because he never allowed me to access his computers. I stayed up all night learning from YouTube tutorials.
By the time he came back the next morning, I would have cleaned up the studio. Things got complicated and he kicked me out.

- Breaking NewsAtiku: Wike’s ‘40-year-old Whisky’ Comment Confirms He’s Under Alcohol InfluenceBreaking | 27 mins ago

*Says Rivers governor’s grouse not about southern presidency
*Commends moves to secure US, UK visa ban against governor
Emmanuel Samuel InyangIn Bayelsa
Presidential candidate of Peoples Democratic Party (PDP), Atiku Abubakar, yesterday, said comments by Rivers State Governor Nyesom Wike that he was sipping a 40-year-old whisky while watching him, and others protest on national television confirmed that Wike spoke under the influence of alcohol. In a statement by his Special Assistant on Public Communication, Mr. Phrank Shaibu, Atiku, cautioned Wike to stay off alcohol, as it had not only affected his voice and demeanour but also his thinking faculty.
Atiku claimed the governor’s grouse with him had nothing to do with southern presidency but a manifestation of his bitter loss. He commended moves to secure visa ban against Wike in the United States and United Kingdom.Wike had said, “As they were protesting, I just sat down and took a 40-year whisky. I called some of my friends and opened the 40-year-old whisky as they were protesting.”
But Atiku advised Wike to stop speaking while drunk. He stated, “Governor Wike has confirmed what we all know. That he is a drunkard. The protest that was led by Waziri Atiku Abubakar on Monday, March 6, 2023, was against the stealing of the mandate of the Nigerian people, which in itself was a noble cause.“For the sake of clarity, the protest occurred around 11.30 am. Wike says he was drinking whisky during the protest at 11.30am on a Monday. This reveals the sort of man he is.”
The former vice president stressed that Wike’s vituperations and wailings had nothing to do with ensuring that the south produced the next president. He said Wike was just a sore loser, who had gone on to deceive other members of his G-5, who were now battling for political survival. The statement said, “Wike’s grouse with Waziri Atiku Abubakar has nothing to do with zoning. He is only wailing because he lost the presidential ticket of the PDP in a fair contest. After losing, he deceived four other governors to join his futile campaign.
“Three governors of the G5 failed woefully at their senatorial elections, including Governor Okezie Ikpeazu, who, as a sitting governor, came a distant third in the Abia South senatorial election. For Governor Seyi Makinde, his ambition is hanging by a thread after his misadventure cost the PDP to lose all three senatorial elections.
“Wike has not held a single meeting with his G-5 members, having dumped them since their defeat. He has been rejoicing over the outcome of the polls even though his men have all lost. This is the sort of man he is, and yet, he claims not to be committing anti-party infractions.”Atiku lambasted Wike for admitting on video to have “manipulated” the outcome of the polls in his state in the last election. He commended the nearly 300,000 Nigerians, who have signed a petition on Change.Org to demand that the United States, the United Kingdom, and the European Union impose a visa ban on Wike.
Atiku alleged, “At this point, I would love to commend the nearly 300,000 Nigerians, who have signed the petition for Wike’s visa sanction. This is a step in the right direction. This is a man, who in every election he has ever been involved in has been characterised by rigging and violence so much so that under his watch, the media tagged his state, ‘Rivers of Blood’.“This is a man, who talks down on traditional rulers in his state, arrests those he doesn’t agree with, seals off the buildings of his opponents, and even revokes Cs of O of those in his bad books.”

*Tinubu, Shettima, APC leaders to meet N’Assembly members-elect tomorrow over zoning of principal offices
*May settle for Christian senate president to balance same faith presidential ticket
Deji Elumoye, Adedayo Akinwale and Udora Orizu in Abuja
With the issuance of the certificate of returns to the members-elect of the House of Representatives by the Independent National Electoral Commission (INEC), the race for the principal offices, particularly the speaker, has begun, ahead of the inauguration of the 10th National Assembly on June 13, THISDAY’s investigation has revealed.
THISDAY also gathered that the meeting between the President-elect, Bola Tinubu; his vice, Kashim Shettima; the leadership of the ruling All Progressives Congress (APC) and its National Assembly members-elect scheduled for Monday in Abuja, has a two-point agenda – zoning of the principal offices of the National Assembly and the March 18 elections.
Ranking members of the House believed to be interested in the position of the speaker include its current Spokesman, Benjamin Kalu (APC, Abia); Idris Wase (APC, Plateau); Muktar Aliyu Betara (APC, Borno); Aminu Jaji (APC, Zamfara); and Alhassan Ado Doguwa (APC, Kano).THISDAY, however, learnt that the ruling APC, which secured majority seats in both the Senate and House of Representatives at the February 25 polls, has not decided on the zoning of the presiding officers of the 10th National Assembly.
It was gathered that in line with the parliamentary tradition, rules, and convention, the political party with the most legislators is expected to form the majority caucus and produce the presiding officers. The party with the dominant members would also constitute the majority leadership. In contrast, the party with the second highest number of lawmakers in the chamber would produce the minority principal officers.
The principal officers, who are the leaders of the majority and minority caucuses, are constituted based on the membership configuration in the lower chamber. While the majority caucus is expected to produce the majority leader, the deputy majority leader, the chief whip, and the deputy whip, the minority caucus will produce the minority leader, the deputy minority leader, the minority whip, and the deputy minority whip.Ranking members, who are returning for the second or more time, are automatically qualified to contest the principal office positions either from the majority or the minority caucus.
Out of the 360 seats in the House of Representatives, the All Progressives Congress (APC) won 162 seats; while the Peoples Democratic Party (PDP) won 102.The Labour Party (LP) and the New Nigeria People’s Party (NNPP) won 34 and 18 seats, respectively, while the All Progressives Grand Alliance (APGA) got four seats. On their part, the Social Democratic Party (SDP) and African Democratic Congress (ADC) won two seats each, while the Young Progressive Party (YPP) clinched one seat.
Following the issuance of certificates of return to the members–elect last Wednesday, the race for the two major presiding offices – Speaker and Deputy Speaker has begun among ranking lawmakers who are members of the APC.With the current Speaker, Hon. Femi Gbajabiamila, and the President-elect, Senator Bola Tinubu coming from Lagos State, the current speaker will likely not retain his position in the 10th National Assembly.THISDAY learnt from a close associate of Gbajabiamila that he would prefer to play any other prominent role in Tinubu’s administration to return to the House as an ordinary member.
Gbajabiamila was conspicuously absent at the International Conference Centre (ICC) Abuja venue of the presentation of Certificates of Return, fuelling speculations that he might take a more prominent position in the incoming administration.Though the APC has not zoned the officers, further investigations by THISDAY revealed that the South-east and North-west geopolitical zones are strongly being considered for the speaker position. Nnolim Nnaji (PDP, Nkanu-East/West).
However, those who make a case for the North-west on the speaker’s position argued that the Senate President should go to the South-east. Idris Wase (APC, Plateau) is also eyeing the top job from the North-central geopolitical zone.
Similarly, Hon. Muktar Aliyu Betara (APC, Borno) is contesting the position from the North-east geopolitical zone. From the North-west geopolitical zone, the duo of Hon. Aminu Jaji (APC, Zamfara) and Alhassan Ado Doguwa (APC, Kano) are both eyeing the seat.
Tinubu, Shettima, APC Leaders to Meet N’Assembly Members-elect Tomorrow over Zoning of Principal Offices Meanwhile, the meeting between Tinubu, Shettima, the leadership of the ruling APC, and the National Assembly members-elect scheduled for Monday at the Banquet Hall of the State House, Abuja, will discuss the issue of zoning and the March 18 elections.
A ranking APC Senator who was also re-elected during February 25, 2023, National Assembly poll told THISDAY that the meeting was called to preview the March 18 elections and discuss the zoning of the leadership of the 10th National Assembly billed for inauguration in June. The South-south Senator, who spoke on condition of anonymity, said the APC leadership believed it was high time the federal parliamentary election was reviewed to plan ahead of the next Saturday’s elections
According to him: “Monday’s meeting will not only review last month’s poll that produced majority APC Senators-elect for 10th National Assembly but will also ensure that all hands are on deck to ensure that coming Saturday’s elections are crisis-free with the ruling party consolidating and improving on its stronghold across the country”.
He added that the second item on the agenda of the meeting scheduled to start by 2 pm with APC National Chairman, Senator Abdullahi Adamu presiding, is the issue of the leadership of the 10th National Assembly, which is supposed to be handled by the party leadership as it presently has 57 Senate seats out of the 98 Senate seats declared so far.APC leaders, he further said, would use the forum to brief the elected parliamentarians on their line of thought over where the presiding officers of the two chambers of the 10th National Assembly will come from.
Sources at the weekend also told THISDAY that both the South-east and South-south are favoured to produce the Senate President of the 10th Assembly as the race hots up.On Friday, APC National Vice Chairman, North-west, Dr. Salihu Lukman, had called on the party’s leadership to zone the positions of the Senate President and the Speaker House of the Representatives to North-west, South-east or South-south.
THISDAY’s investigation revealed that the odds favoured the South-east and South-south to occupy the number three seat in the land.A source who preferred to remain anonymous told THISDAY that while the former Governor of Abia State, Senator Orji Kalu, is eyeing the covered seat, former Governor of Akwa Ibom State, Senator Godswill Akpabio, Senator Osita Isunaso and the Governor of Ebonyi State, Dave Umahi are also interested the position. The source said: “The South-east is favoured under the circumstances, and I know Orji Kalu is positioning for it, and he’s lobbying Asiwaju very well.
“Umahi wants it too, but I think what will count against him is that he’s a first-timer. But some people say that it doesn’t really matter, that it is not in their rule that a first timer cannot do it. After all, Godswill Akpabio was a first-timer when he became a principal officer.“I also know Akpabio too is pushing for it, but I don’t know how that will pan out. Akpabio argues that the position is not sacrosanct to the South-east, it is whoever can get the support.”
Other ranking APC Senators being tipped for the 10th Senate Presidency include former Senate Leader, Senator Ali Ndume; former Governor of Gombe State, Senator Danjuma Goje; Chairman of Senate Services Committee, Senator Sani Mohammed Musa and Chairman of Senate Committee on Appropriations, Senator Jubrin Barau.
Sources claimed all the interested Senators are already reaching out to their colleagues, especially the new Senators-elect.One of the contenders for the coveted seat of the Senate President, Senator Barau, has already met formally with 70 senators-elect in Abuja.

Igbawase Ukumba in Lafia
The governor of Nasarawa State, Abdullahi Sule, at the weekend said he has raised the annual Internally Generated Revenue (IGR) of the state from N7.1 billion to over N20 billion.
The governor made the disclosure in Lafia at a media parley, adding that the development has led to the payment of workers’ salaries without allocation from the federal government.
“I have raised the annual IGR of Nasarawa State from N7.1 billion to over N20 billion and as such, we can now pay salaries of our workers for months even without allocation from federal government.”
According to Sule, “hitherto, the state had been purely a civil service state which only got resources from the federation accounts. Before I became the governor in 2019, Nasarawa State was not getting any revenue from industries because there was none.
“Today I can tell you that the significant amount of our revenue is from the various industries we have attracted, that are operating in different Local Government Areas of the state.”
Sule highlighted some of the industries to include: Olam Rice in Doma LGA, Dangote Sugar Refinery – Awe LGA, Flour Mill Nigeria PLC and Azman Rice Farm both – Toto LGA, and the Gudi Marble Industry in Akwanga LGA.
“More than 30 per cent of the Marble being sold in the Federal Capital Territory (FCT) – Abuja today is from Nasarawa State,” he added.
In the agricultural sector, the governor maintained that his administration had constructed so many rural roads that were facilitating easy transportation of people and farm produce from rural communities to urban centres.
“We have also invested hugely in security to ensure that farmers and herders go about thier economic activities without any fear of being attacked,” Sule stated.

Gains in Dangote Cement, MTN Boost Market Cap by N145bn

The stock market of the Nigerian Exchange Limited (NGX) last week extended its positive run for the third consecutive week, primarily driven by the gains in Dangote Cement Plc and MTN Nigeria Communications stocks.
Thus, NGX All-Share Index notched a 0.48 per cent week-on-week (W-o-W) gain to close at 55,794.51 basis points as the market capitalisation appreciated by N145 billion W-o-W to close at N30.395 trillion.
Across the sectors last week, performance was largely on a mixed trend. Thus, there were declines in the NGX Banking, NGX Consumer Goods, and NGX Oil & Gas indices of 1.82 per cent, 0.26 per cent, and 3.82 per cent from the previous week, while positive price movement was seen in the NGX Industrial Goods index and NGX Insurance index with a gain of 1.71 per cent and 0.70 per cent respectively through the week as investors posed their expectations for the dividend season.
However, market breadth for the week was negative as 22 equities appreciated in price, 41 equities depreciated in price, while 94 equities remained unchanged. Julius Berger Nigeria led the gainers table by 10 per cent to close at N26.95, per share. Trans-Nationwide Express followed with a gain of 9.88 per cent to close at 89 kobo, while International Energy Insurance went up by 8.33 per cent to close to N1.30, per share.
On the other side, MRS Oil Nigeria led the decliners table by 18.99 per cent to close at N27.95, per share. Conoil followed with a loss of 18.89 per cent to close at N38.00, while FTN Cocoa Processors declined by 13.33 per cent to close at 26 kobo, per share.
Overall, a total turnover of 1.023 billion shares worth N20.221 billion in 18,650 deals was traded last week by investors on the floor of the Exchange, in contrast to a total of 1.910 billion shares valued at N18.436 billion that exchanged hands last week in 20,311 deals.
The Financial Services Industry (measured by volume) led the activity chart with 414.427 million shares valued at N5.646 billion traded in 8,136 deals; contributing 40.50 per cent and 27.92 per cent to the total equity turnover volume and value respectively. The Conglomerates Industry followed with 307.868 million shares worth N479.512 million in 1,122 deals, while the Industrial Goods Industry traded a turnover of 104.234 million shares worth N10.354 billion in 1,334 deals.
Trading in the top three equities; Transnational Corporation, Guaranty Trust Holding Company (GTCO) and BUA Cement accounted for 447.809 million shares worth N9.556 billion in 2,018 deals, contributing 43.76 per cent and 47.26 per cent to the total equity turnover volume and value respectively.
Meanwhile, analysts said that the positive performance witnessed in the Nigerian equities market is expected to be maintained this week.
The market last week sustained its positive momentum despite the seesaw movement that resurfaced through the week as a result of the portfolio reshuffling exercise by equity investors ahead of more dividend announcements by listed companies. While the benchmark index moves further towards the 56,000 psychological mark based on its strong momentum, the audited financials and corporate actions are expected to give clear direction to the market notwithstanding the uncertainties associated with the general elections.
Cordros Securities Limited said “we expect market performance to be dominated by the bulls in the week ahead, as we expect investors to take positions in stocks with attractive dividend yields. However, we envisage an undulating pattern will emerge as intermittent profit-taking activities will likely persist.
“Overall, we advise investors to seek trading opportunities in only fundamentally justified stocks as the weak macro story remains a significant headwind for corporate earnings.”
Afrinvest Limited said that “despite the downbeat investor sentiment, we expect the market to trend upwards as investors continue to react to corporate earnings results.”
In the new week, Cowry Assets Management Limited expected “a mixed trend to continue in the market as investors react to the dividend and position for the anticipated financials from primarily tier-one banks.
“While market players place their bull’s eye on dividend-paying companies and defensive stocks to protect their portfolios ahead of the governorship election and post dividend adjustment, we advise investors to trade companies with sound fundamentals and, as such, should take advantage of price corrections in line with domestic and global trends.”

MTN, Dangote Cement, 12 Others Pay Revenue Agencies N461.2bn Amid Multiple Taxations

Amid multiple taxations, the audited results released so far by 14 companies listed on the Nigerian Exchange Limited (NGX) revealed that MTN Nigeria Communication Plc, Dangote Cement and 12 others paid a total of N461.2 billion as tax in 2022 to the Federal Inland Revenue Service (FIRS), other tax authorities in Nigeria and African countries where they operate.
The amount paid last year represents an increase of 10.7 per cent over the N416.64 billion reported by these 14 companies in the 2021 financial year.
The sectors covered by THISDAY are companies in the cement manufacturing, petroleum marketing, telecommunication, Fast-moving consumer goods (FMCG), among others are top players in other African countries.
The 14 firms reported a whopping sum of N1.09 trillion in profit after tax in the period under review, an increase of 12.6 per cent from N965.4 billion reported in 2021.
Their companies’ tax expenses contributed to N2.83 trillion company income tax paid in 2022 financial year, according to the National Bureau of Statistics (NBS) in its latest company income tax report provided by the Federal Inland Revenue Service (FIRS).
Companies operating in Nigeria are required by law to remit tax income to state, federal government agencies, among other agencies where they operate.
Aside from paying the statutory rate of 30 per cent of total profit as the company’s income tax, companies operating in Nigeria are meant to pay Tertiary Education Tax, National Information Technology Development Agency (NITDA) Tax and Nigeria Police Trust Fund Levy.
The tertiary education tax is imposed on every Nigerian company at the rate of 2.5 per cent of the assessable profit for each year of assessment, while the Act that established the Nigeria Police Trust Fund was meant to receive funds from a levy of 0.005 per cent of the net profit of companies operating a business in Nigeria and other various sources, which will be utilized for the training and welfare of personnel of the Nigeria Police Force.
THISDAY analysis of the results showed that MTN Nigeria Communication, followed by Dangote Cement paid the highest tax to revenue-generating agencies where they operate in 2022.
As MTN Nigeria Communication reported N175.1 billion tax expenses in 2022, an increase of 27 per cent from N138.03 billion in 2021, Dangote Cement declared N141.69 billion tax expenses in 2022 from N173.93 billion in 2021.
The combination of Dangote Cement, Dangote Sugar Refinery and Nascon Allied Industries where Aliko Dangote has a major stake as Chairman and investors paid a total sum of N172.16 billion as tax expenses in 2022 from N187.16billion in 2021.
Commenting, the CEO, MTN Nigeria, Mr. Karl Toriola in a statement stated that, “Compliance remains at the heart of our business and embedded in the strategic priorities that underpin our Ambition 2025 strategy.
“Accordingly, we are pleased to have been recognised by the NGX as the listed company with the highest level of compliance with the Rules of the Exchange and other applicable laws and regulations.
“This follows our recognition by FIRS as one of the most tax-compliant organisations in Nigeria. These demonstrate our commitment to and track record of compliance and sound governance.
“Our Road Infrastructure Tax Credit (RITC) project reached a significant milestone with the Federal Executive Council’s approval to restore and refurbish the 110-kilometre Enugu-Onitsha Expressway. This has paved the way for the commencement of the project, which, once completed, will positively impact the lives of Nigerians and contribute to the country’s overall economic growth.”
Analysts have expressed the importance of companies remitting taxes to government agencies, stressing on the role played by listing on the Exchange that gives room for companies to be transparent in tax payment to government agencies where they operate.
Capital market analyst, Mr. Rotimi Fakeyejo said the failure to pay tax might force the government to shut branches and truncate operations, stating that the tax system in Nigeria must be streamlined to enhance effective remittance in order not to create dispute between the company and government.
Fakeyejo, however, added that tax remittance is meant to facilitate economic growth and companies must always oblige in promoting remittance, most especially to state governments where they have branches.
According to him, taxes paid by companies are based on laws and regulations, stressing that companies are meant to play by the rules, which has to do with full disclosure.
He explained further that, “A good number of income that companies generate are exempted from tax. Banks are not meant to pay tax income on treasury Bills, government bonds and agriculture loans.
“If you take all of those, sometimes you will find out that tax banks are paying effectively on their profit, maybe less compared to manufacturing companies, not that they are not deliberately not paying taxes.”
He stressed the need for banks to come together and make a total tax income contribution to the country’s Gross Domestic Product (GDP).
On his part, Vice-President, Highcap Securities Limited, Mr. David Adnori stated that listed companies over the years maintained stronger profit, which is meant to contribute to government tax revenue.
He expressed that most companies that were reluctant to come to the stock market were hiding their financials or were scared of take-over by wealthy Nigerians.
He said: “Once the government can work together with the FIRS to enforce tax laws, there would be no hiding place for companies. Thus, they will be forced to come to the market.”

*Say INEC failed to live up to high expectations it had created for itself
*Insist Nigeria, Africa must learn from mistakes
Emmanuel Addeh in Abuja
Two United States diplomats, Ambassador Mark Green and Johnnie Carson, have said even Nigerian citizens who supported the winners of the February 25 presidential and National Assembly elections in the country were disappointed with the electoral process. In a joint treatise, both envoys, who monitored the elections, insisted that critical lessons must be learnt very fast from the shortcomings of the last polls by Nigerians and Africans, with a view to forestalling such flaws in the future.
Writing for the Washington-based President Woodrow Wilson Centre, a United States non-partisan policy forum for tackling global issues through independent research, Green and Carson noted that, among other issues, many polling stations opened late while poll workers reported material shortages.
While Green was administrator of the US Agency for International Development, Executive Director of the McCain Institute, US ambassador to Tanzania and four-term House of Representatives member, Carson was ambassador to Nigeria and several other African countries.
The ambassadors recalled that on February 25, Nigeria held its presidential election with millions of Nigerians going to the polls for the opportunity to elect their new leader, but noted that the process was fraught with irregularities. The diplomats wrote, “At a time when the world is experiencing a democratic decline, Nigerians stood in line – sometimes for hours – for the chance to have their voices heard.
“Unfortunately, the National Democratic Institute/International Republican Institute Election Observation Mission – for which we were both observers – declared that this election ‘fell short of Nigerian citizens’ reasonable expectations.’“Citizens were disappointed with the electoral process, including those who supported the candidates who were declared winners. Among other issues, many polling stations opened late, and poll workers reported material shortages.“Overall, as the IRI/NDI joint mission found, Nigeria’s Independent National Electoral Commission (INEC) failed to live up to the high expectations it had created for itself.”
They recalled that three days after Election Day, the candidate of ruling All Progressives Congress (APC), Bola Tinubu, was declared president-elect. They stressed that the main opposition parties had now gone to court to challenge the results.According to the envoys, there is a lot of evidence that Africans prefer democratic systems of government to other forms. They explained that in addition, Africans also wanted accountable governance. The diplomats contended that even with improvements over the last decade, governance overall had struggled, “flat lining” across the continent since 2019, a worrying development since it can affect African Union’s Agenda 2063 goals.
According to the duo, success for democracy in Nigeria – the biggest economy and largest democracy on the continent – has the potential to inspire democracy in neighbouring countries and across the continent, as Nigeria is one of the most influential countries in Africa – and the world. While much of the world’s attention is “understandably” taken up by headline-grabbing events, such as the Russia/Ukraine conflict and earthquakes in Turkey and Syria, Green and Carson argued that the world could not afford to ignore happenings in Nigeria.
They stated, “However, the international community cannot afford to overlook elections – and importantly, democracy – across Africa this year. Case in point, Nigeria: Africa’s most populous country and one of the world’s largest democracies.“With projections to become the world’s third most populous country by 2050, it is imperative that a solidified democratic system is established in order to effectively support the people’s needs and promote progress throughout the continent.
“US foreign policy toward Nigeria should focus on proactively strengthening democracy and governance. To help reach this goal, our direct engagement with African leaders and citizens is important – not because we have it perfectly figured out but because we know that democracies build better futures.”The ambassadors noted that US policy toward Nigeria should consistently advocate strong civil society involvement, fortify political parties, implement checks and balances on government officials, and establish strong legislative systems. The US and other international partners, the envoys stressed, must continue to support civil society and the institutions that support democratic principles, and in turn, strengthen democracy.Although the logistical issues associated with the elections disappointed many Nigerians, the ambassadors argued that their continued hope for their country’s democratic system should inspire all. While elections are an important benchmark in democratic development, they said the real work of building democratic institutions happens between elections.According to the ambassadors, “What happens over the next weeks and months in Nigeria will be vital. It is important that the president-elect prioritises forming an inclusive government that considers the voices and concerns of all Nigerians.“On March 18, Nigerians will go back to the polls to vote for their state governors and Houses of Assembly, and there will be several important elections on the continent this year.“The world should continue to watch the process closely, and ensure that lessons from the Nigeria presidential election are not just recorded but used to strengthen every election that lies ahead.”The envoys stated that there was no question about the enormous potential that existed in the country and Africa, stressing that the continent can only achieve its full potential if citizens have an opportunity to participate in a democratic process that allows their votes to be cast and their voices to be heard.

The Central Bank of Nigeria (CBN), yesterday, directed commercial banks and other financial institutions in the country to continue to accept and pay out the old N200, N500, and N1,000 notes till December 31, 2023, in line with a recent Supreme Court ruling.
In a statement signed by CBN’s Acting Director, Corporate Communications, Dr. Isa Abdulmumin, the central bank disclosed that it had met with the Bankers’ Committee and directed that the old banknotes remained legal tender alongside the redesigned notes.
But in apparent reaction to public unease over the federal government’s long silence and delayed response to the March 3 Supreme Court ruling on the currency redesign, the presidency yesterday said the CBN did not need a further directive from President Muhammadu Buhari to comply with the apex court’s order. The presidency said this in a statement by presidential spokesperson, Mallam Garba Shehu.
Relatedly, the Nigeria Labour Congress (NLC), yesterday, gave the federal government one-week ultimatum to resolve the present scarcity of both the naira and petrol, which had caused untold hardship to the masses, or face a nationwide workers strike.
In another development, CBN Governor, Mr. Godwin Emefiele, described as fake news a report that he had launched a fresh plot against the president-elect, Bola Tinubu.
The CBN stated, “In compliance with the established tradition of obedience to court orders and sustenance of the rule of law principle that characterised the government of President Muhammadu Buhari, and by extension, the operations of the CBN, as a regulator, deposit money banks operating in Nigeria have been directed to comply with the Supreme Court ruling of March 3, 2023.
“Accordingly, the CBN met with the Bankers’ Committee and has directed that the old N200, N500 and N1000 banknotes remain legal tender alongside the redesigned banknotes till December 31, 2023. Consequently, all concerned are directed to conform accordingly.”
Earlier yesterday, Buhari washed his hands of the reported refusal of the federal government to comply with the ruling of the Supreme Court extending the validity of the old banknotes to December 31, 2023. The presidency said the CBN did not require a presidential directive to comply.
The presidency, in a statement issued by presidential spokesperson, Shehu, stated that at no time did Buhari direct the Attorney General of the Federation (AGF) and the CBN not to comply with the apex court’s order on the on-going currency swap.
Shehu said Buhari, in the close to eight years of his administration, had never done anything to delay or obstruct the course of justice, but would rather continue to respect the judicial process and authority of the courts.
The statement said, “The Presidency wishes to react to some public concerns that President Muhammadu Buhari did not react to the Supreme Court judgement on the issue of the N500 and N1,000 old currency notes, and states here plainly and clearly that at no time did he instruct the Attorney General and the CBN governor to disobey any court orders involving the government and other parties.
“Since the president was sworn into office in 2015, he has never directed anybody to defy court orders, in the strong belief that we can’t practise democracy without the rule of law and the commitment of his administration to this principle has not changed.
“Following the on-going intense debate about the compliance concerning the legality of the old currency notes, the presidency, therefore, wishes to state clearly that President Buhari has not done anything knowingly and deliberately to interfere with or obstruct the administration of justice.
“The president is not a micromanager and will not, therefore, stop the Attorney General and the CBN governor from performing the details of their duties in accordance with the law. In any case, it is debatable at this time if there is proof of wilful denial by the two of them on the orders of the apex court.
“The directive of the president, following the meeting of the Council of State, is that the bank must make available for circulation all the money that is needed and nothing has happened to change the position.
“It is an established fact that the president is an absolute respecter of judicial process and the authority of the courts. He has done nothing in the last eight or so years to act in any way to obstruct the administration of justice, cause lack of confidence in the administration of justice, or otherwise interfere or corrupt the courts and there is no reason whatsoever that he should do so now when he is getting ready to leave office.”
Furthermore, the president’s spokesman noted that the negative campaign and personalised attacks against the president by the opposition and all manner of commentators were unfair and unjust, as no court order at any level had been issued or directed at him.
The statement said further, “As for the cashless system the CBN is determined to put in place, it is a known fact that many of the country’s citizens who bear the brunt of the sufferings, surprisingly support the policy, as they believe that the action would cut corruption, fight terrorism, build an environment of honesty and reinforce the incorruptible leadership of the president.
“It is, therefore, wide off the mark to blame the president for the current controversy over the cash scarcity, despite the Supreme Court judgement. The CBN has no reason not to comply with court orders on the excuse of waiting for directives from the president.”
Buhari also rejected the impression that he lacked compassion, saying, “No government in our recent history has introduced policies to help economically marginalised and vulnerable groups like the present administration.”
Collect Old Notes or Be Shut Down, Sanwo-Olu, Soludo Tell Banks
Meanwhile, to try to ameliorate the suffering engendered by the federal government’s sloppy implementation of the currency redesign, the governors of Lagos State, Mr. Babajide Sanwo-Olu, and Anambra State, Professor Chukwuma Soludo, yesterday, directed residents of their respective states to continue transactions with the old naira notes.
Sanwo-Olu gave the directive in a letter he wrote and addressed to Lagosians yesterday.
The governor said his directive on collection of the old naira notes was based on the Supreme Court verdict, which extended the validity of the notes to December 31, 2023, and the Bankers Committee’s directive to the commercial banks during its meeting on Sunday, March 12, 2023.
Sanwo-Olu expressed displeasure at the difficulties and pain Lagosians currently faced due to the naira redesign. He said the Lagos State government would sanction any business that failed to collect the old notes, warning that any bank branch that refuses to collect the notes would be shut down immediately and reported to the CBN.
The governor told Lagos residents to lodge complaints against any bank that refused to accept deposits of old notes to the Lagos State Consumer Protection Agency (LASCOPA).
The statement read, “My dear Lagosians, I have noted the difficulties you have been having over the naira redesign crisis. I feel your pain.
“I discussed with top officials in CBN who assured me that commercial banks were directed to accept the old N500 and N1,000 notes as deposits and pay them out for withdrawals.
“They informed me that commercial banks got the directive at a Bankers Committee meeting on Sunday, March 12, 2023.
“I, therefore, urge you to go ahead and have transactions with the old notes. Lagosians should feel free to use the old notes for commercial purposes. Retailers, transporters, traders and all businesses must not reject them, as they remain legal tender, following the Supreme Court verdict, which extends the validity of the notes to December 31, 2023.”
Sanwo-Olu warned, “Any business that fails to collect the notes will be heavily sanctioned. I, therefore, advise Lagos residents to freely accept and transact their businesses with the old currency notes (N200; N500; and N1,000) as well as the new notes.
“If any bank refuses to accept deposits of old notes, please, lodge a complaint with the Lagos State Consumer Protection Agency (LASCOPA) via these numbers; 08124993895, 09064323154, 08092509777.
“The Lagos State Government will report the bank to the CBN and immediately shut down the offending branch.
“I thank you so much and assure you that all this, too, shall pass, as the authorities are working to ensure that the teething problems of the redesigning of our currency are resolved.”
Soludo advised also residents of his state to freely accept and transact businesses with the old N200, N500 and N1,000 as well as the new notes.
In a statement he personally signed, which was obtained yesterday by THISDAY, Soludo disclosed that he spoke with the CBN governor on the matter by telephone and he confirmed that in compliance with the Supreme Court ruling, he had directed commercial banks to accept the old banknotes and also load their ATMs with the currencies.
The governor threatened to shut down any commercial bank that rejected the old N500 and N1,000 notes from depositors and refused to issue same to customers.
Soludo, a former CBN governor, added, “Commercial banks have been directed by the central bank to dispense old currency notes and to also receive same as deposits from customers.
“Tellers at the commercial banks are to generate the codes for deposits and there is no limit to the number of times an individual or company can make deposits.
“The governor of the CBN gave the directive at a Bankers’ Committee meeting held on Sunday, 12th March, 2023. The governor, Dr. Godwin Emefiele, personally confirmed the above to me during a phone conversation on Sunday night.
“Residents of Anambra are, therefore, advised to freely accept and transact their businesses with the old currency notes (N200, N500 and N1,000) as well as the new notes. Residents should report any bank that refuses to accept deposits of the old notes. Anambra State Government will not only report such a bank to the CBN, but will also immediately shut down the defaulting branch.”
Until the announcement by the governor, residents of Anambra had been complaining that banks issued to them old currency notes but would not accept the notes from depositors.
NLC Gives FG 7-Day Ultimatum to End Currency Scarcity
NLC gave the federal government one-week ultimatum to resolve issues causing prolonged scarcity of the naira as well as petrol. It warned that at the expiration of the ultimatum, the union might be forced to call out its members for a national strike.
Addressing journalists in Abuja on the decision of the Central Working Committee of the NLC, the president, Joe Ajaero, said the labour movement had observed with regret the suffering workers and Nigerians had been subjected to due to the cash squeeze resulting from government’s naira redesign policy. Ajaero said NLC had resolved to issue a seven-day ultimatum to the federal government to end the cash crunch or workers would stay away from duty nationwide.
Briefing newsmen on the position of labour, Ajaero said, “The congress wishes to inform the federal government that we will no longer keep quiet on this issue of perennial fuel scarcity and arbitrary increase of petroleum products prices.
“On the issue of cash crunch, the NLC is giving the federal government of Nigeria, the agencies of government, including the CBN and top banking institutions, seven working days to address the issue of the cash crunch.
“If they fail to do this at the expiration of the seven days, the Congress is directing all workers in the country to stay at home because it has become very difficult to even assess one naira to enter vehicles to your workplace.”
Ajaero said it had become very difficult to buy products, especially from traders who, in most cases, did not have bank accounts.
He stated, “This is the situation we have found ourselves. The federal government came out with the policy that even the old currencies are still valid. What we have discovered is that even when the banks give you those old currencies, the traders are not accepting it. And even when you take it to the same banks, the banks are not accepting it either. We are being frustrated to a level that we can no longer keep quiet.”
On the political situation in the country, NLC urged all gladiators to remember that the interest of the country was paramount and do everything reasonably possible to make sure that the system was maintained.
NLC also cautioned the judiciary to ensure that it did justice to the complaints of aggrieved politicians.
Emefiele Debunks Fake News, Denies Alleged Plot against Tinubu
CBN Governor, Mr. Godwin Emefiele, described as fake news a report that he had launched a fresh plot against the president-elect, Bola Tinubu.
Emefiele, in a statement signed by Abdulmumin, titled, “Re- Emefiele launches fresh plot against President-elect Tinubu,” and made available to THISDAY yesterday, also denied the allegation in the report that he made certain amounts of money available to the governorship candidate of Labour Party (lp) in Lagos State, Gbadebo Rhodes-Vivour.
The statement said, “The attention of the CBN has been drawn to a story published in The Nation newspaper of Monday, March 13, 2023 edition, alleging that the governor, Mr Godwin Emefiele, has launched a ‘fresh plot against President-elect’.
“The aforementioned story went further to allege that the governor has made certain amount of money available to a political aspirant ahead of March 18, 2023 gubernatorial poll.
“We wish to inform members of the public that this story is completely false and malicious, as the governor does not know and has never met or even spoken with Mr. Gbadebo Rhodes-Vivour either in person or through proxy.
“We wish to reiterate that the CBN governor does not take part in politics and, therefore, urge anyone with contrary information to prove the governor wrong should provide such facts.
“As such the governor and team at the CBN should be allowed to focus on their assigned job with a view to achieving statutory mandates of the Bank.”

The Governor of the Central Bank of Nigeria (CBN), Mr. Godwin Emefiele, Thursday launched the Nigerian National Domestic Card scheme that will among other things, avail Nigerians the sovereignty of their data, lower costs of transactions, and address challenges in foreign exchange usage.
Emefiele said at a time when foreign exchange challenges persist globally, all card and online transactions would go on the domestic card scheme with immediate effect.
The domestic card system which presents a critical moment in the development of Nigeria’s payment system is also expected to reduce the exploitations associated with cash handling.

- Coming sooner — 2024, Tesla’s order page states optimistically — will be the dual-motor and tri-motor “Cyberbeast” versions. The AWD Cybertruck will start at $79,990, get 340 miles, hit 0-60mph in 4.1 seconds, and do a top speed of 112 mph. And the tri-motor trim will run you $99,990, produce a ridiculous 845 horsepower with 10,296 lb-ft of torque, and get around 320 miles of range.Image: TeslaDuring the event, Musk invited Tesla chief designer Franz Von Holzhausen to re-do the infamous, botched window strength demonstration from 2019, in which he smashed the supposed armor plated glass with a ball bearing. This time he threw a baseball — pretty weakly, I might add — but the glass withstood the projectile this time around. The event was uncharacteristically short for a Tesla party. There appeared to be far fewer attendees than were at the original Cybertruck debut back in 2019. After Musk went through some the features, including the truck’s bulletproof exterior and some of its performance capabilities, he quickly announced it was over — and then helped about a dozen or so of the first customers drive off in their trucks. Not mentioning the price may have been a deliberate choice, because clearly those numbers were much less attractive than the prices we saw back in 2019. That said, customers are sure to be happy with the towing and acceleration capabilities. The angular, stainless steel electric truck has long fascinated fans of Tesla, but its many delays have led some to question whether the truck would ever actually arrive. The production has reportedly been extremely challenging for the company, mostly due to the choice to use ultra-hard stainless steel for the exterior. Musk insisted the truck be bulletproof, which further complicated the process. The polarizing design has been another flashpoint. The polygonal shape and sharp angles were meant to signal that Tesla couldn’t be less interested in competing in the traditional truck market. That has led some experts to conclude that the Cybertruck is likely to be more of a halo vehicle for the company, luring in customers to instead buy its more practical (and available) vehicles, like the Model 3 and Y.The angular, stainless steel electric truck has long fascinated fans of TeslaIndeed, in the run-up to the event, Musk sought to “temper expectations” around the Cybertruck, warning investors that it wouldn’t start to generate “positive cash flow” for the company for at least a year to 18 months. Tesla has said it expects to begin producing 250,000 trucks annually by 2025, but the production ramp would be extraordinarily difficult. In an earnings call in October, Musk said “demand was off the charts,” noting that over 1 million people have paid $100 in a refundable deposit to reserve the Cybertruck. But he also admitted that the company may have bitten off more than it could chew. “We dug our own grave with the Cybertruck,” he said. “You know, nobody — in general, probably nobody digs a grave better than themselves.”Now that it’s out, much of the focus will redirect to Tesla’s production and how quickly the company can get these vehicles into customers’ hands. As a new entry into the highly competitive truck market, there will also be some attention paid to how well it competes with other electric trucks out there, like the Ford F-150 Lightning and Rivian R1T.But those questions may be moot because Tesla is just not expected to make very many — at least not at first. The polarizing design is likely to turn off a broad swath of truck customers. And its arrival in the midst of a cooling market for electric vehicles means there are just way fewer early adopters and tech-obsessives who are in the market for a giant polygon on wheels — cool factor notwithstanding. From a sales perspective, the Cybertruck could end up being a huge hit. But even so, it won’t come anywhere close to matching the volume of trucks that Ford, Chevy, and others typically sell. For Musk to jump feet first into the highly lucrative, intensely competitive truck market with a divisive design and difficult production process seems like an odd choice — even for a guy who’s become somewhat famous for odd choices.Much of the industry has shifted to bigger vehicles in recent decades, with trucks in particular making up some of the bestselling models. The companies make a lot of them, they sell a lot, and then they reap the profits. Tesla does not seem poised to reap the same benefits from the Cybertruck.233 COMMENTS233 NEW

Dablack – Ogologo Ft Balloranking - Dangote officials, refiners tackle marketers over imported PMS20th September 2024

Emmanuel Inyang writing Domestic crude oil refiners and officials at the Dangote Petroleum Refinery have kicked against the commencement of the importation of Premium Motor Spirit, popularly called petrol, by major oil marketers in Nigeria.
Oil refiners alleged that some imported fuels were of low quality when compared with the ones produced by the Dangote refinery, a position that was reiterated by officials of the $20bn Lekki-based plant.
The PUNCH exclusively reported on Wednesday that three major oil marketers were expecting vessels of imported petrol this week barring any unforeseen circumstances.
Dealers said about 141 million litres of PMS are being conveyed to Nigeria by oil vessels following the full deregulation of the downstream oil sector by the Federal Government.
Health 360: Sickle Cell…
They also noted that the recent hike in the pump prices of petrol produced by the Dangote refinery and released by the Nigerian National Petroleum Company Limited on Monday had allowed room for PMS imports.
Reacting to this on Thursday, officials at the Dangote refinery and the Crude Oil Refiners Association of Nigeria tackled the marketers, stressing that aside from the fact that the situation would increase the demand for United States dollars, the imported fuels were of low quality.
“These people (marketers) are importing dirty fuels that are toxic,” an impeccable source at the Dangote refinery who spoke to one of our correspondents in confidence, declared.
The source added. “They are importing substandard fuels and if allowed they will not stop importing such. We have more than enough, but these guys don’t want it. They want the game to continue, but the game will not continue.”
Another official at the plant stated that Nigerians should be concerned about the importation of substandard petroleum products into the country.
“You have to be concerned about the quality of the products they import. These are toxic fuels when you consider their blending process. All this is just to maximise profit,” the official stated.
Their positions were corroborated by the Publicity Secretary of CORAN, Eche Idoko, who alleged that some of the substandard fuels were blended in Malta or Togo.
He called for backward integration, saying some were afraid that Dangote would become a monopoly.
“The fear marketers are having is that Dangote will become a monopoly, but that has been taken care of by Dangote subscribing to our association. With the Petroleum Industry Act in place and all the agencies in play, there is no way that Dangote can become a monopoly.
